Are You Prepared To Protect Your Rights If You Are In An Automobile Accident?
Most of us never prepare for unpleasant experiences in our lives. Understanding your rights when in an automobile accident is one potentially unpleasant experience for which we should be prepared. It is important to know some of the legal consequences and actions that can be taken by an individual that could protect your legal rights in both civil and quasi-criminal legal actions that arise from an auto accident.
Always make sure that you acquire as much information from the other driver(s) at the scene of the accident. Most importantly, you should write down their insurance information and driver’s license number. Always WAIT for a police officer and report the accident. Never leave the scene of the accident. This is a very serious offense, which could result in excessive fines and points on your license, and most seriously, potential incarceration if there is any serious injury to another individual.
Dealing with insurance companies after an automobile accident can be an arduous and frustrating process. An individual should, when in an automobile accident, contact the insurance carrier directly. It is important to have the event recorded for processing as soon as possible so that all issues relevant to personal injury and property damage can be addressed. More importantly, if another driver sues you the response from your insurance carrier will be more responsive if you notified them of the accident prior to being served with a civil action complaint for personal injury or property damage.
We at Mattleman, Weinroth & Miller hope you will drive safely so that you never have to experience this type of unfortunate situation. Friendly reminders for everyone- drive defensively and DON’T DRINK AND DRIVE.
