What are diversionary programs in New Jersey?

  • New Jersey has several types of diversionary programs for first time offenders
  • Municipal Court has two:
    • The conditional discharge program is for drug offences
    • The conditional dismissal program is for non-drug offences
  • Superior Court has the pre-trial intervention program
  • Each of these programs allow first time offenders to maintain a clean criminal record
  • You need to ask to be admitted into any and all of these programs
  • All programs have certain conditions, such as, for instance reporting to probation
  • For drug offences, you may be required to submit to random drug testing
  • If you successfully complete any of these programs, you will not have a criminal record relating to the charge that got you into court
  • This will allow to continue with your livelihood, education, financial aid and personal life circumstances that could be negatively impacted by a criminal conviction on your record
