If you’re charged with drug possession in your car, there are three critical factors affecting the outcome: 1) the amount of drugs found; 2) how the drugs were packaged (personal use or for distribution); and 3) whether you have any previous drug convictions.
Separate from the drug possession charge, you can be charged with a motor vehicle offence – CDS in a motor vehicle, which can result in a two year loss of license.
If the drug amount is under 50 grams, the penalty is a six month jail term and $1,000 fine. Over 50 grams and it’s 18 months in jail, a $25,000 fine and minimum 6 month loss of license.
