As much fun as spending time with friends and family will be for residents of Pennsylvania, it is also important to remember that law enforcement will be out in full force trying to make sure everyone stays safe. Both state and local law enforcement agencies will be looking for anyone breaking the law, especially those who choose to drive under the influence of alcohol.
The penalties for driving under the influence in Pennsylvania are very serious and should not be taken lightly. If a driver is found to have a blood alcohol content of 0.08 or higher, the consequences can be life-changing. The first-offense DUI penalties in Pennsylvania are as follows:
BAC between 0.08 and 0.099 percent, or an undetermined BAC:
- Up to 6 months of probation
- A fine of $300
- An ungraded misdemeanor
- Participation in the alcohol highway safety school
- Possible mandatory substance abuse treatment
BAC between 0.10 and 0.159 percent:
- Drivers license suspension for 12 months
- A fine between $500 and $5,000
- Participation in the alcohol highway safety school
- An ungraded misdemeanor
- Imprisonment for between 48 hours and 6 months
- Possible mandatory substance abuse treatment
Individuals with a BAC greater than 0.16 percent will face the same consequences as the previous category except the fine is between $1000 and $5000 and imprisonment is at least 72 hours.
